Terms of Service

These Terms of Service (the “Terms”) form a binding agreement between Collicare Logistics (“Collicare”, “we”, “us”) and any person or company that books, ships, pays for, receives or otherwise uses our services or website (“you”, “Customer”). Please read them carefully — by booking a shipment or submitting a payment you accept them in full.

1. Service Description

Collicare Logistics provides international and domestic freight forwarding, express and standard parcel shipping, air and ocean freight, road transport, warehousing, 3PL fulfilment, customs documentation support, shipment tracking and related supply-chain services.

We act as a contracting carrier and/or freight forwarder and may engage subcontracted carriers, airlines, shipping lines, hauliers, agents and last-mile partners to perform all or part of the transport. Transit times, service availability, routings and rates are estimates only and may vary by lane, service level, seasonality, capacity, weather, customs processing and applicable regulations. Quoted delivery dates are not guaranteed unless we have expressly confirmed a guaranteed service in writing.

2. Acceptance of Terms and Eligibility

By accessing our website, requesting a quote, submitting a shipment request, tendering cargo or making a payment, you confirm that you have read, understood and agree to these Terms and to our Privacy Policy. If you are booking on behalf of a company, you confirm you are authorised to bind that company. You must be at least 18 years old to use our services.

We may amend these Terms at any time. The version published on this page at the time of your booking applies to that booking. Continued use of the website or services after an update constitutes acceptance of the amended Terms.

3. User Responsibilities

You are solely responsible for:

  • Providing complete, accurate sender and consignee names, addresses, phone numbers and email addresses.
  • Accurately declaring the nature, quantity, weight, dimensions and commercial value of the goods.
  • Packaging goods adequately for the mode of transport, handling and stacking they will undergo.
  • Ensuring the shipment contains no prohibited, restricted, undeclared or unlawful items.
  • Providing all commercial invoices, packing lists, licences, permits, certificates and customs data required by the origin, transit and destination countries.
  • Complying with all applicable export control, sanctions, anti-money-laundering and customs laws.
  • Being reachable for delivery coordination and responding promptly to requests for information or payment.

Inaccurate declarations may result in re-weighing, re-rating, additional charges, customs penalties, seizure, return, abandonment or destruction of the shipment, all at your cost and risk. You indemnify Collicare against any fine, penalty, duty, tax, storage cost, claim or loss arising from your breach of this section.

4. Quotes, Charges and Payment Terms

Quotes are indicative and based on the information you provide. Final charges are calculated on actual gross or volumetric (dimensional) weight, whichever is greater, plus any applicable surcharges — including fuel, remote-area, oversize, residential delivery, waiting time, re-delivery, storage, demurrage, customs clearance, inspection, handling and currency adjustment charges.

Unless a credit account has been agreed in writing, all charges are payable in advance and in full before a shipment moves or is released for delivery. Payments are made through the payment method shown on our payment page; where a payment reference and receipt upload are requested, the payment is only treated as received once our finance team has verified the receipt against the reference.

Late payment may result in the shipment being held, storage charges accruing, interest being applied at the statutory rate under Norwegian law, and recovery and collection costs being charged to you. We may exercise a general and particular lien over goods in our possession for any unpaid amount. All prices are exclusive of duties, taxes and VAT unless expressly stated otherwise.

5. No Refund Policy

All payments made to Collicare Logistics are final and strictly non-refundable. This includes freight charges, shipping fees, customs and clearance fees, duties and taxes collected on your behalf, storage and handling charges, insurance premiums, administrative fees and any surcharges — whether paid before, during or after transport.

Once a payment has been submitted and verified, no refund, credit, chargeback or reversal will be issued for any reason, including but not limited to: change of mind, cancellation of the shipment by you, delayed transit, customs inspection or hold, incorrect information supplied by you, refusal of the shipment by the consignee, abandonment of the goods, or the shipment being returned to origin.

Charges paid for services that are partially performed are likewise non-refundable, as costs are incurred with carriers, agents and authorities at the moment of booking. Any goodwill adjustment, service credit or re-shipment is entirely at Collicare’s sole discretion and does not create a right to a refund. Claims for loss or damage are handled exclusively under the claims process in Section 9 and are not treated as refunds.

6. Shipping and Delivery Terms

Risk in the goods passes according to the agreed Incoterms or, where none are agreed, on delivery to the consignee’s address or nominated collection point. Delivery is deemed complete when the shipment is handed to the consignee, to any person at the delivery address, to a nominated pickup point or access-controlled location, or when a proof of delivery is recorded electronically.

Transit times exclude the day of pickup, weekends, public holidays and time spent in customs. Where delivery cannot be completed, we may attempt re-delivery, place the goods in storage or return them, in each case at your cost. Shipments unclaimed after 30 days may be treated as abandoned and disposed of, with any outstanding charges remaining payable.

Collicare may place a shipment on hold where payment is outstanding, documentation is missing, a customs or regulatory issue arises, or where required by an authority. While a hold is active the tracking timeline is paused and no further milestones will advance until the hold is released.

7. Customs, Duties and Taxes

International shipments are subject to customs inspection, valuation, duties, import VAT and regulatory clearance in the destination country. Unless expressly agreed as delivered-duty-paid, all duties, taxes, clearance fees, inspection fees, demurrage and storage charges levied by any authority or agent are payable by you or the consignee and must be settled before the goods are released.

We may appoint or act as a customs agent on your behalf and rely entirely on the information and documents you supply. Collicare is not liable for delays, holds, inspections, fines, seizures, confiscation or destruction imposed by customs or any other authority, nor for charges that arise from an incorrect declaration, HS classification or missing licence.

8. Liability Limitations and Insurance

Our liability is limited in accordance with the mandatory international conventions and standard trading conditions applicable to the mode of transport, including the CMR Convention (road), the Montreal/Warsaw Convention (air), the Hague-Visby Rules (sea) and, where applicable, NSAB 2015 for freight-forwarding services.

To the maximum extent permitted by law, Collicare is not liable for indirect, consequential, special or punitive damages, nor for loss of profit, revenue, market, goodwill, contract or business opportunity, however arising. We are not liable for delay unless a guaranteed delivery service was purchased and confirmed in writing.

We are not liable for loss or damage caused by force majeure, war, civil unrest, strikes, embargoes, epidemics, extreme weather, port or airport congestion, acts of authorities, inherent vice of the goods, insufficient or unsuitable packaging, or errors in the information you supplied.

Basic carrier liability is not insurance. Extended all-risk cargo insurance is available on request and is strongly recommended for fragile, high-value or time-critical shipments. Insurance must be arranged and paid for before pickup; premiums are non-refundable.

9. Claims Process

Claims for loss, damage or delay must be submitted through our Claims page or in writing to our claims team, and must include the tracking number, a description of the issue, photographic evidence, the commercial invoice and any proof of delivery notation.

Notice deadlines are strict: visible damage or shortage must be noted at delivery and reported within 7 calendar days; concealed damage within 14 calendar days; delay within 21 calendar days of delivery; and non-delivery within 60 calendar days of the shipment date. Claims received after the applicable convention’s time limit are time-barred.

Each claim receives a claim ticket number and progresses through Submitted → Under Review → Resolved. Goods and packaging must be retained for inspection until the claim is closed. A claim will not be considered while any charge on the account remains unpaid, and claim settlement — where accepted — is capped at the applicable convention limit and does not constitute a refund of freight charges.

10. Prohibited and Restricted Items

The following may not be tendered to Collicare without prior written approval, and in many cases not at all:

  • Currency, bullion, bearer instruments, precious metals and loose precious stones.
  • Narcotics, controlled substances and drug precursors.
  • Firearms, ammunition, explosives, fireworks and weapon parts.
  • Dangerous goods, hazardous materials, corrosives, compressed gases, lithium cells and flammable liquids, unless declared and accepted under IATA/IMDG/ADR rules.
  • Live animals, human remains and body parts.
  • Counterfeit, pirated, stolen or infringing goods.
  • Pornographic, obscene or unlawful material.
  • Perishable food, plants and temperature-sensitive pharmaceuticals without an approved cold-chain service.
  • Tobacco, alcohol, e-cigarettes and vape products without the required licences.
  • Any item whose carriage, import or export is prohibited by law or by sanctions.

Tendering a prohibited item is a material breach. We may open, inspect, hold, surrender to authorities, return or destroy such shipments without liability, and you remain liable for all charges, fines and losses arising.

11. Accounts, Website Use and Security

Tracking numbers are issued by Collicare only and may not be generated, altered or reused by customers. You are responsible for keeping your account credentials confidential and for all activity under your account. You may not attempt to access data that is not yours, scrape or overload the website, reverse-engineer our systems, submit fraudulent receipts or impersonate another person or company.

12. Intellectual Property

The Collicare name, logo, website design, text, images and software are our property or that of our licensors and may not be copied, reproduced or used commercially without our written permission.

13. Termination and Suspension of Service

We may suspend or terminate services, accounts or website access — with or without notice — where there is non-payment, suspected fraud, a fraudulent or altered payment receipt, an undeclared or prohibited shipment, abusive behaviour towards staff, a breach of these Terms, or a legal, sanctions or regulatory requirement.

On termination, all outstanding charges become immediately due, goods in our possession may be held under lien, and Section 5 (No Refund Policy), Section 8 (Liability) and Section 14 (Governing Law) survive.

14. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of them or out of any shipment are governed by the laws of Norway, without regard to conflict-of-law rules. The competent courts of Kristiansand, Norway have exclusive jurisdiction, except where mandatory consumer law or an applicable international convention provides otherwise. Where a provision of these Terms is found unenforceable, the remaining provisions continue in full force.
